1. Introduction

Clinerion is a software and real-world data services company with international operations in the US, Switzerland and Türkiye. Clinerion provides software solutions supporting life sciences companies and hospitals in the process of developing new medicines.

Clinerion’s key technology solution, Patient Network Explorer (PNEx), automatically finds eligible patients for clinical studies in Big Data settings, such as hospitals and other healthcare organizations.

At Clinerion, the privacy and security are of paramount importance. Clinerion is committed to protecting the data you share with us. This privacy policy explains how Clinerion processes information that can be used to directly or indirectly identify an individual (“Personal Data”) collected through diverse channels.

All information is stored securely and is accessed by authorized personnel only. Clinerion implements and maintains appropriate technical, security and organizational measures to protect Personal Data against unauthorized or unlawful processing and use, and against accidental loss, destruction, damage, theft or disclosure.
 

2. General Principles

With regards to Personal Data, and following the European General Data Protection Regulation (2016), Clinerion operates on the following principles:

a) the fair and transparent collection and processing of Personal Data;

b) the legitimate interests pursued by Clinerion in the context of providing its services;

c) the protection of Personal Data from data breach through technical measures (e.g. data encryption) and organizational measures (e.g. only authorized users are given password-protected access);  

d) the rights of individual data subjects to view, export, correct, and/or delete what data we hold on that data subject on request by that data subject, unless contradicted by country laws of Switzerland;

e) the immediate notification of Personal Data breaches to data subjects;

f) the provision of appropriate safeguards and adequate protections for Personal Data transfers to third countries.
 

3. Collection and use of Personal Data

3.1. Journalist contact data

Clinerion collects personal contact details such as name, e-mail address, postal address, phone number, organization name for the purposes of providing the individual with information and updates on Clinerion’s products and services, for example via delivery of press releases or invitations to press events.
 

3.2. Business contact data

Clinerion collects personal contact details such as name, e-mail address, postal address, phone number, organization name, for the purposes of providing the individual with information and updates on Clinerion’s products and services, for example via delivery of newsletters and other mailings.
 

3.3. Human Resources data

Clinerion collects personal information of its employees like name, address, e-mail, Skype name, phone number, birth date, bank account details, appraisal information, time tracking information, AHV number, etc., for processing salaries, adhering to good company governance and for satisfying legal requirements in regard of social security.

Clinerion collects personal information of job applicants from their curriculum vitae (CV) like name, address, e-mail, Skype name, phone number, birth date, etc., for evaluating the applicant’s suitability to work for Clinerion.
 

3.4. Website Visitors

Clinerion may collect, record and analyze information of visitors to its website. We may record your IP address and use cookies. Clinerion may add information collected by way of page view activity. Furthermore, Clinerion may collect and process any Personal Data that you volunteer to us in our website’s forms.

Such Personal Data may comprise your IP address, first and last name, your postal and email address, your telephone number, your job title, your areas of interest, interest in Clinerion products, and certain information about the company you are working for (company name and address), as well as information as to the type of relationship that exists between Clinerion and yourself.

Clinerion gathers data about visits to the website, including numbers of visitors and visits, Geo-location data, length of time spent on the site, pages clicked on, and where visitors have come from.
 

3.4.1. Purpose of processing Personal Data

Clinerion uses the collected data to communicate with visitors, to customize content for visitors and to improve its website by analyzing how visitors navigate its website.
 

3.4.2. Sharing Personal Data

Clinerion may also share such information with service vendors or contractors in order to provide a requested service or transaction or in order to analyze the visitor behavior on its website.

All data is anonymized meaning the cookies carry no personally identifiable information. These cookies help us to understand our visitors’ behavior and allow us to make improvements to enhance our users’ experiences.

__utmz 6 months from set/update Stores the traffic source or campaign that explains how the user reached your site. The cookie is created when the javascript library executes and is updated every time data is sent to Google Analytics.

3.4.4. Links to other sites

Please be aware that while visiting our site, Visitors can follow links to other sites that are beyond our sphere of influence. Clinerion is not responsible for the content or privacy policy of these other sites.
 

3.5. Patient Network Explorer User data

When you register:

  • We collect first name, last name, organization, email addresses and user name for the account system, as well as mobile numbers for a multifactor authentication. Every account is unique due to the uniqueness of the email addresses and user name, and which is used to identify you as a user, log you in, notify you and connect you with your collaborators.
  • We collect names to make the interaction between you and your collaborators easier.
  • We collect IP addresses to detect misuse of the system, combat abuse and for logging purposes.
     

When you perform a query against patient data of a site (hospital)

  • We collect names to make the interaction between you and the site and to detect the misuse of the system.
     

3.5.1. Cookies

  • We set a cookie for logging you in. There's no way to avoid that. Cookies are essential for keeping you authenticated.
  • We use Google Analytics and they set a few cookies on their own. While this service monitors your behavior, Google promises all data is anonymized.
  • You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting, you won't be able to use your account.
     

3.6. Patient data

Clinerion’s Patient network Explorer (PNEx) queries a de-identified copy of a partner hospital’s electronic health record (EHR) database, unlinked from identifiers, and returns aggregated counts. The hospital’s EHR database is housed and fully under the control of the hospital’s IT department. As PNEx deals only with de-identified, unlinked patent data, this data does not fall under the scope of the European General Data Protection Regulation (2016).
 

4. Retention and deletion

Clinerion will maintain the data for as long as the data is required for the purposes mentioned above, until the individual withdraws consent or as long as it is necessary for legal purposes.
 

For Patient Network Explorer (PNEx) users

PNEx users may manage or withdraw their data consent directly through the system dashboard.

PNEx users can achieve this by deleting their account. For security reasons, enabling the sites to monitor who queried their patient data, detecting misuse of the system, we will keep the PNEx users’ Personal Data for one year after they delete their account. One year after they delete their account, all their Personal Data will be automatically removed from the system.
 

For Human Resources data

We need to keep Human Resources data for ten years by law.
 

For all others

Individuals may withdraw consent at any time by contacting privacy@clinerion.com.

Please note that withdrawal of consent shall not affect the lawfulness of Clinerion’s use of Personal Data for the purposes mentioned above which occurred before the withdrawal of consent.

Individuals may request to view, correct, or delete their data in Clinerion’s database at any time by contacting privacy@clinerion.com.

6. Changes of the Privacy Policy

We assume that you have read this document and agree to its contents. We reserve the right to change our privacy policy as necessity dictates. Continued use of Clinerion’s website and Patient Network Explorer after having been informed of any such changes to these conditions implies acceptance of the revised privacy policy.

Business contacts and journalists who are stored in Clinerion's business contacts database are also informed of such changes and have the same rights to remove their details from the contacts database.

Employees are also informed of such changes by internal means.

Only current job applicants are informed of such changes.
